If you intentionally make false or untrue statements or if you intentionally violate your obligations to provide information, clarification or to present supporting documents, you shall lose your entitlement to receive insurance benefits. Should you violate any of those obligations through gross negligence, we shall be entitled to reduce our payments on a pro rata basis in relation to the severity of your fault, up to 100% of the claim. No such reduction shall be made in case you are able to prove that you did not violate such obligation through gross negligence.
However, we shall remain obliged to perform despite your violation of the obligations to provide information, clarification or to present supporting documents to the extent you are able to prove that the violation of obligations through intentional act or gross negligence was neither the cause for the occurrence of the event insured against nor for the establishment or the scope of our obligation to perform. Should you violate your obligation to provide information, clarification or to present supporting documents through a fraudulent act, we shall be released from our obligation to perform in any case.
If any third party is entitled to contractual performance in your stead, such third party shall be obliged to provide information, clarification or to present supporting documents, as well.
